All vehicle purchases made through The Guaranteed Best Choice are subject to the terms outlined in this Buyer Agreement, in accordance with applicable federal and state laws. By completing a transaction-whether through bidding, submitting an offer, or using the "Buy Now" feature-you acknowledge that you have read, understood, and agreed to the terms herein. If you do not accept these conditions, please do not proceed with a purchase.

Buyer Agreement Overview

This document applies specifically to the vehicle listed on this page. Any action taken to purchase the vehicle constitutes acceptance of this agreement.

Vehicle Purchase Conditions

Auction Outcomes and Seller Rights
The finalization of a vehicle sale is subject to the Seller's confirmation. The Seller maintains the exclusive right to cancel, postpone, or revoke a transaction for any reason, at any time, even after a high bid has been received, but prior to title assignment. The Seller also reserves the right to void any sale impacted by typographical errors, pricing mistakes, or other issues at the Seller's discretion.

Indemnity for Sale Cancellation
The Buyer waives all claims and holds the Seller harmless for any damages, costs, or liabilities arising from the cancellation of a sale or removal of a vehicle listing, including legal fees. The Buyer further agrees to defend and indemnify the Seller against third-party claims related to such cancellations.

Bidding & Offers
All auction vehicles are subject to reserve pricing. If reserve is not met, the Seller may propose counteroffers. If the reserve is met, the highest bidder will be awarded the vehicle, pending Seller's final approval.

Buy Now Option
Vehicles listed with a "Buy Now" price may also be subject to negotiation. The Seller may respond with counteroffers based on offers submitted.

Payment & Collection

Fees and Charges
There is no added dealer fee. However, Florida buyers may incur additional charges such as registration, title, or agency fees. Buyers are responsible for confirming fee details prior to purchase.

Deposit
A $200 deposit is due within 24 hours via PayPal for any accepted sale. This deposit is non-refundable. Vehicles without timely deposits may be relisted without notice.

Final Payment
The full payment must be made within five business days of the sale. Accepted forms include wire transfer, cash, or cashier's check. Credit union checks require prior written approval. Returned checks must be resolved within two business days, and all costs related to recovery will be borne by the Buyer.

Sales Tax
Florida buyers must pay applicable sales tax and surtax based on their county.
Out-of-state buyers may qualify for reduced Florida tax if picking up in person.
All tax collection will follow Florida law.

Shipping Estimates
Any shipping estimates provided are for reference only. They are not guaranteed and should not be relied upon as final. The Seller disclaims all responsibility for variances in shipping cost.

Vehicle Delivery & Transportation
Buyers are responsible for all shipping arrangements and costs. While the Seller may assist with finding a carrier upon request, the contract and any liabilities rest solely between Buyer and carrier. Damage during transport is the sole responsibility of the Buyer. Buyer agrees to hold the Seller harmless for any such damages.

Vehicle Pickup Window
Vehicles must be collected within 9 business days. After that, daily storage fees apply. Seller assumes no liability for vehicles left on-site past the pickup deadline.

Collections
Buyers are responsible for any collection costs incurred due to non-payment, including legal and agency fees.

Disclosures, Disclaimers, and Warranties

1. Vehicle Representation
   The Guaranteed Best Choice does not verify or guarantee any details presented about the vehicle, including features or specifications. Buyers are encouraged to personally inspect or research all listings prior to purchase.
2. Registration and Exportation
   There is no assurance that any vehicle can be registered or exported outside Florida. Laws vary by state and country, and buyers are responsible for understanding registration or import restrictions.
3. Photos and Condition
   Images are provided for general reference and do not represent a full assessment of the vehicle's condition. On-site inspection is strongly advised.
4. Title Branding
   Vehicle title classifications may change upon registration in other states or countries. This risk lies solely with the Buyer.
5. Inspection Encouraged
   Buyers may arrange a pre-purchase inspection with a mechanic.
6. Common Used Car Conditions
   Used vehicles may have defects, including but not limited to frame damage, engine leaks, exhaust issues, clutch slipping, and malfunctioning electrical or air conditioning systems. The buyer should perform due diligence.
7. Vehicle History and Recalls
   Visit ftc.gov/usedcars and safercar.gov for history reports and recall checks using the vehicle VIN.
8. EV Manufacturer Services
   The Seller is not responsible for any digital service suspension, software limitation, or EV feature deactivation imposed by a manufacturer or dealer.
9. Tax Credits

Clean Vehicle Tax Credit Disclaimer (Federal Used EV Tax Credit) - Important Buyer Notice

This vehicle may qualify for a Federal Used Clean Vehicle Tax Credit under Section 25E of the Internal Revenue Code as amended by the Inflation Reduction Act. However, qualification is not automatic and is subject to strict IRS rules regarding

• Vehicle qualification criteria
• Tax filing status
• Use of the vehicle
• Purchase price limits
• Dealership certification participation

By purchasing this vehicle, the Buyer acknowledges and agrees to the following:

1. No Guarantees - This dealership does not guarantee that the Buyer will receive any federal, state, or local tax credit, rebate, or incentive of any kind related to this vehicle.
2. IRS Determination - Eligibility for the tax credit is determined solely by the IRS, not by The Guaranteed Best Choice. The Buyer must consult directly with a tax advisor or the IRS (www.irs.gov) to confirm eligibility.
3. No Point-of-Sale Rebates - Unless explicitly stated in a signed agreement, this dealership does not participate in the point-of-sale rebate system and does not deduct any tax credit amount from the sale price.
4. No Assistance or Liability - The dealership is not responsible for:
   • Completing, filing, or submitting IRS tax forms
   • Missed or disallowed credits due to incorrect or incomplete filings
   • Buyer misunderstandings or assumptions about eligibility
5. Buyer's Duty - It is the sole responsibility of the Buyer to research and confirm all tax-related information before completing the transaction.

IMPORTANT: Tax credit eligibility is not guaranteed. Buyer must confirm with the IRS. This dealership assumes no responsibility for IRS submissions, ineligibility, or missed credits.

Warranty & Service Contracts

No Dealer Warranty
Vehicles are sold strictly "AS-IS," with no dealer-provided repair guarantees.

Optional Service Protection
A complimentary limited warranty - the "National Platinum Drivetrain" plan - covering major powertrain components for 3 months or 3,000 miles is included. Other extended warranties are available for purchase.

Summary of Covered Parts
Covered parts include components from engine, transmission, axle assemblies, air conditioning, electrical system, and limited roadside and rental car assistance.

Limitations
The warranty excludes commercial use, abuse, damage from accidents, overheating, poor maintenance, and other standard exclusions. Full policy available upon request.

Dispute Resolution and Legal Jurisdiction

Dispute Process
Before initiating legal action, Buyer must first notify the Seller in writing and attempt resolution. If unresolved within 30 days, legal action may proceed.

Governing Law
Florida law governs this agreement, regardless of Buyer location.

Jurisdiction
All legal claims must be filed in the courts of Broward County, Florida.

Liability Limitations

The Guaranteed Best Choice is not liable for indirect, incidental, or consequential damages, including lost business or profit. If liability is found, damages shall not exceed the vehicle's purchase price.

Assignment and Termination

The Buyer Agreement is non-transferable. The Seller may terminate this agreement at any time, and any provisions intended to survive termination will remain in force.
